Strickland v. Medlen, 397 S.W.3d 184 (Tex. 2013)

As the Texas Supreme Court opinion indicates, the common law denied humans the ability to recover for the death of another.  It was only in the 20th century, when states enacted statutes allowing for spouses and estates to recover for the “wrongful death” – committed negligently, recklessly, or intentionally – of another, that civil lawsuits for the death of another were allowed.

1) What is the reasoning supporting the court’s decision in Strickland?  Be specific about identifying reasons.

2) What are the interest groups that played a role in this case, and what were the groups’ concerns?

Prepare: In 2000, Environmental Health Tracking Project Team at Johns Hopkins School of Hygiene and Public Health, Department of Health Policy and Management, made the recommendation that a health tracking system was necessary to ensure that the recent mapping of the genome might be fully realized. Access to basic information was necessary because it was important to track who was more at risk from exposure to environmental hazards and to define the health gap. The missing information keeps communities and public health officials from assessing and reducing these health risks and issues. The committee outlined that cost of chronic disease was $325 billion in annual healthcare and lost productivity and while the U.S. has one of the world’s best healthcare systems, there was still no system in place to track the link between health and environment.

In 2001, Congress mandated that funds be allocated to establish the CDC’s National Environmental Public Health Tracking (EPHT) Program, which is led by the National Center for Environmental Health’s (NCEH) Environmental Health Tracking Branch (EHTB).tracking system. By 2015, the CDC had its own tracking page (http://ephtracking.cdc.gov/showHome.action (Links to an external site.)Links to an external site.), with 25 states had tracking systems in place, (http://ephtracking.cdc.gov/showStateTracking.action (Links to an external site.)Links to an external site.).

Click on the following webpage (http://www.cdc.gov/about/history/tengpha.htm (Links to an external site.)Links to an external site.) of the CDC that outlines the greatest public health achievements in the 20th century. Click on one of the health issues on the page (it can be related to your final project) and read about its history and present day challenges, if any. Then click on  http://ephtracking.cdc.gov/showStateTracking.action (Links to an external site.)Links to an external site. and choose two particular states (feel free to use your state, if it has a tracking page) and a specific disease or health issue that the state is tracking (Again, it can be related to your final project). Develop or look for data, graphs, and maps on your choice and decipher what the data presents. Feel free to play around with the tracking systems of both states.

Reflect (3).png

Reflect: As you looking at the websites considering the following questions:

  • What do you learn about the history of the disease you chose?
  • Would you argue that this is why these states choose to track this particular data?
  • How far back does this state track the data?
  • What do you learn from the data?
  • How does the data from the two states compare?
  • Can you explain the difference and why it exists?
  • What do you notice about gender, race, and class?

Write (3).png

Write: As you consider the history and the greatest achievements in public health as well as current health issues on the tracking systems, what is the connection between the past and present when it comes to the link between health and the environment? How is gender, race, and/or class connected to health and the environment?

Discuss (3).png

Guided Response: Your initial post should be at least 300 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts in no less than 100 words by Day 7.

Consider the following scenario:

A proposed amendment to the Georgia State Constitution will eliminate the current county-based property tax system and replace it with a statewide property tax system.

Would you support / vote for this amendment?  What factors are important for you in considering this issue?

************************ Student Response #1 ***************************

I would support this amendment. While there may be concern that a statewide system would limit scope and possibly transparency, there is always a possibility that closeness to a circumstance can cause blindness to factors that would appear as obvious concerns from an outside perspective. The reality that there is “always a possibility” of anything does not automatically mean that an alteration is called for, of course, but in this case it isn’t a bad thing. Local governments should have a voice in what occurs in the places that they represent, of course. In Chapter 13 of State and Local Government, Bowman and Kearney assert that “Altering the unequal distribution of property values is essentially beyond the control of local governments. As a result, ‘wealthy suburbs remain wealthy, poor communities remain poor, and services remain unequal.'” The property tax levied always varies to a large degree in different counties or cities. Circuit breakers have been set in place in order to reduce this inequity and promote fairness, but these efforts can only go so far and frequently make little impact; the difference in property values “have important implications for the quality and distribution of services.” Proposition 13 was enacted due to the rapid increase in property taxes levied on California residents; according to the text, some elderly citizens were “forced to sell their homes to pay their property tax.” When California enacted Proposition 13 and stepped in on behalf of the local governments, they “dropped from the eighth-highest property tax state to the twenty-eighth.” One of the biggest problems with property taxes is the difficulty that comes with the appraisal process; if there was a statewide property tax system, the local government would not have to shoulder this burden.

************************ Student Response #2 ***************************

No, I wouldn’t vote for this amendment to be put in place. I believe the county-based property tax system is put in place for a reason and is working for us already, so why try to fix it? County’s set the rate of taxes and receive the revenue from that, therefore can use it for leverage and benefit greatly. A area that has a higher tax rate is mostly likely generating lots of revenue and putting it towards making the community even better, such as improving schools, libraries, and parks. This creates a prestigious and safe community that people aspire to be like. If this were to be a statewide property tax, all counties would be the same and it would not matter what part of town you move to. Also, counties differ greatly based on their resources. A county in Atlanta does not compare and cannot have the same amount of tax rate as a county in south Georgia. This is because of the large amount of jobs, people, and resources that Atlanta has. Atlanta also has a very scarce amount of land, therefore property tax rates should be higher because of scarcity whereas south Georgia has a great amount of land and less amount of people.
