You may choose to use EITHER the “Was that Harassment” case study as your scenario, OR you can one of the following five scenarios to write your bad news message.

  1. Notify someone they are not accepted into your sorority, fraternity, club, team, etc. Use a realistic situation to explain why this person is not accepted.
  2. Pretend a group member in one of your classes has not been participating and you have decided to take action with the instructor to get the person removed from your group.
  3. Tell a classmate that you have decided not to invest in his/her start-up idea.
  4. Pretend you have interviewed someone at your job and management has decided not to hire them.
  5. Use the case study in the text on pages 264 – 265. Assume the role of Nick and write an email to your uncle explaining why you think the company needs to get out of chemicals. You think the chemicals division could be sold for around half a million dollars. You currently have about $740,000 in debt related to the chemicals division. You would need to lay off ten employees, all of whom have been loyal to the company for many years. However, you think it’s necessary because the chemical division lost nearly $200,000 last year, and you expect things to get worse.

If using the “Was that Harassment” case study, assume Teaira has moved forward with a complaint. After meeting with Coltra leadership, compliance representatives, and legal counsel, you have determined this incident constituted harassment.
Writing as Suzanne Bibb (see 162 -3 of your Case) and address your Bad News Message to Jackson. While maintaining Teaira’s confidentiality, inform Jackson of the disciplinary measures you are taking. Use your discretion in determining Jackson’s punishment. You can:

  • Immediately terminate
  • Require enrollment in training courses, with continued employment conditional on prompt attendance
  • Issue a warning, outlining the harassment warranting your letter, and your expectations moving forward, describing ramifications for continued violations

Ethical Dimensions of Research Studies In the best-selling book, The Immortal Life of Henrietta Lacks (Skloot, 2010), the author highlights the true story of an African-American woman who died in 1951 from cervical cancer. What makes her story unique is that prior to her death, cells from her tumor were removed and successfully grown in a petri dish. This was the first time scientists were able to successfully replicate cells outside the body, and it is estimated that billions of Lacks’ cells have been used in medical research. However, Henrietta Lacks was never asked for permission to take a sample and her family was never made aware of the widespread use of her cells. Although the culturing of her cells has been pivotal for advancing research, strong ethical concerns later arose about using these cells without patient or family approval. Reference: Skloot, R. A 38-year-old woman presents to the office with complaints of weight

loss, fatigue, and insomnia of 3-month duration. She reports that she has

been feeling gradually more tired and staying up late at night because

she can’t sleep. She does not feel that she is doing as well in her occupation

as a secretary and states that she has trouble remembering things.

She does not go outdoors as much as she used to and cannot recall the

last time she went out with friends or enjoyed a social gathering. She

feels tired most of the week and states she feels that she wants to go to

A former waitress for a local restaurant chain is suing the company after enduring months of alleged sexual harassment including one instance when she received a threat after reporting that her private sex tape had been circulated amongst coworkers.
A sexually explicit video of her – that was meant for her boyfriend – was “inadvertently” posted by her in the group chat of a Facebook group that consisted of the restaurant wait staff.
She maintains that the restaurant not only failed to take steps to remove the video and discourage the sharing of the video, but management or staff also forwarded and shared the video with the restaurant’s kitchen staff on Facebook.
Because of the video she alleges her co-workers began to tease and harass her by calling her names: “goddess of love” and “love queen.”
After two attempts to report the treatment to the corporate office, the company finally responded by asking for more information. She, in turn, filed out a form describing what happened and gave the company a new contact cell phone number. A few hours later, she received the following text message on that phone number: “You can run but you can’t hide. You won’t be taking anyone down but yourself.”
Your task is to determine whether based on these facts and your interpretation of the elements required to prove a tort (negligence and/or intentional tort) what arguments can you make that the waitress was sexually harassed and the restaurant is liable for the harassment? Make sure to identify all the elements required to prove the tort. What might her damages be should she be successful? Secondly, does the business possess any legitimate defenses to a civil charge of sexual harassment?
You can assume the company follows federal law (To wit, Title VII of the Civil Rights Act of 1964, which recognizes sexual harassment as a form of employment discrimination. Now you need to develop a proposal for a wellness education program that will help bridge the gaps in health care service delivery.
