A former waitress for a local restaurant chain is suing the company after enduring months of alleged sexual harassment including one instance when she received a threat after reporting that her private sex tape had been circulated amongst coworkers.
A sexually explicit video of her – that was meant for her boyfriend – was “inadvertently” posted by her in the group chat of a Facebook group that consisted of the restaurant wait staff.
She maintains that the restaurant not only failed to take steps to remove the video and discourage the sharing of the video, but management or staff also forwarded and shared the video with the restaurant’s kitchen staff on Facebook.
Because of the video she alleges her co-workers began to tease and harass her by calling her names: “goddess of love” and “love queen.”
After two attempts to report the treatment to the corporate office, the company finally responded by asking for more information. She, in turn, filed out a form describing what happened and gave the company a new contact cell phone number. A few hours later, she received the following text message on that phone number: “You can run but you can’t hide. You won’t be taking anyone down but yourself.”
Your task is to determine whether based on these facts and your interpretation of the elements required to prove a tort (negligence and/or intentional tort) what arguments can you make that the waitress was sexually harassed and the restaurant is liable for the harassment? Make sure to identify all the elements required to prove the tort. What might her damages be should she be successful? Secondly, does the business possess any legitimate defenses to a civil charge of sexual harassment?
You can assume the company follows federal law (To wit, Title VII of the Civil Rights Act of 1964, which recognizes sexual harassment as a form of employment discrimination. Sexual harassment being further defined as quid pro quo and hostile work environment.)that bans any form of sexual discrimination in the workplace. It further defines sexual harassment as unwelcome sexual advances imposed upon an employee by someone in authority. Such unwanted sexual advances may come in the form of sexual jokes, repeated offensive comments, or looks, intentional body contact, indecent propositions or forced sexual relations.
However, this discussion question requires you to answer under business tort doctrines found in chapter 19, not under Title VII, although this federal law establishes a minimum level of duty.

Develop a 5–7-page proposal for a wellness education program for a specific population. Integrate aspects of culture, CAM and spirituality, and linguistics into the program. Explain how to market the program to the population, and explain the ethical, legal, and economic factors that can affect the health of the population.

Note: The assessments in this course build upon each other, so you are strongly encouraged to complete them in sequence.

Health care initiatives focus on changing demographics and emerging health problems. Among the challenges faced by health care professionals are cultural and linguistic competence and the role they play in the ability to provide effective care. Health care professionals need to develop skills in conducting gap analyses within their own communities, design effective health education and wellness programs to address those gaps, and remain mindful that effective care depends on the ability to build trust within the community being served.
By successfully completing this assessment, you will demonstrate your proficiency in the following course competencies and assessment criteria:

Competency 1: Explain the principles and concepts of disease prevention and health promotion for diverse and vulnerable populations.

(IMPORTANT) -Explain how educating a population about health promotion and disease prevention benefits the health and wellness for a population.

Competency 2: Develop evidence-based health promotion and disease prevention initiatives for diverse and vulnerable populations.

(IMPORTANT) -Integrate linguistic and cultural considerations, CAM, traditional medicine, holistic health, and spirituality into an evidence-based wellness plan for a population.

Competency 4: Examine the ethical, legal, and economic factors related to health disparities in diverse and vulnerable populations.

(IMPORTANT) -Describe the ethical principles that can affect preventative care and health promotion.
(IMPORTANT) -Explain how local laws, federal laws, and the Affordable Health Care Act can affect preventative care and health promotion.
(IMPORTANT) -Explain the economic impact of clinical prevention and health promotion related to health disparities for a population.

Competency 5: Communicate in a manner that is scholarly, professional, and consistent with expectations for members of the health care professions.

(IMPORTANT) -Write content clearly and logically, with correct use of grammar, punctuation, APA formatting, and mechanics.

Assessment Instructions

Preparation
Your team has succeeded in demonstrating the need for a health promotion and disease prevention initiative for the population identified by your Windshield Survey assessment. Now you need to develop a proposal for a wellness education program that will help bridge the gaps in health care service delivery.
Use the Capella library and the Internet to find scholarly and professional resources that will help you propose a wellness education program for the health concern of your population. Find at least four resources to use in this assessment. You may also want to review the previous assessments you completed in this course.
Requirements
Based on your Windshield Survey and Organizational Evaluation assessments, complete the following:

Design an evidence-based wellness program to address the primary health concern of the population that integrates:

Cultural considerations: Will you need to consult with someone from the population on how to approach the delivery of your program?
CAM, traditional medicine, holistic health, and spirituality considerations.
Linguistic considerations: Will you need interpreters or translators for either written or oral presentations?
Educational considerations: What will be the best way to educate the population?

Describe how you will market or advertise the wellness program.

What are the benefits the program offers the population?
Will you need incentives to ensure participation and completion of the program?

Explain the ethical, legal, and economic factors that impact the health and wellness of the population. For example:

The ethical considerations (such as justice, non-malfeasance, and duty) that can affect preventative care and health promotion.
Local laws, federal laws, and the Affordable Health Care Act that can affect preventative care and health promotion.
The potential economic impact of clinical prevention and health promotion related to health disparities of your population.

The format for this assessment should be a professional proposal. If possible, ask about the format used for proposals in your organization and follow that. Follow APA formatting for your in-text citations and references.
Additional Requirements

Include a title page and reference page. The completed assessment should be 5–7 pages in length, not including a title page and a reference page.
Reference at least four current scholarly or professional resources.
Use current APA format for citations and references.
Use Times New Roman font, 12 point.
Double space.

Capture and analyze the key arguments of the two following readings: 1) Winters and Gould, WB Accountability in Chad
2) Stiglitz Ch3: Making Trade Fair
NOTE: the two texts are not directly related to each other. Your reading essay therefore consists of two free-standing discussions.
Structure each discussion as follows:
– What is the text broadly about / what is the author’s main argument? Don’t summarize the entire text, zero in on the big picture.
– Identify one or two examples or events that are used as illustration
– Discuss the broader implication of the text in relation to lecture material and possibly other course readings.
Ask yourself, what did I learn from this text?
Total length (for both reading discussions): 1000 to 1200 words.
Guidelines:
– Put your name at the top of the page.
– Note word count in the upper right corner of the page.
– Try to stick to the word count. If you end up above it, edit it down: delete, rephrase, condense, consolidate. – Put the full bibliographical reference at the top of each discussion.
Style:
– Clearly organize your argument, avoid repetition.
– Avoid statements like “I agree with the author” without explaining why.
– Generally avoid fillers like “I think” “I believe”. This is your analysis; it is understood that what you write is your take on these readings.
Citations:
Use direct quotes very sparingly and generally paraphrase in your own words. When you use a direct quote, reference it with page number. Such as: Nye concludes that “the open international system has served the United States well.” (p. 2).
Grading: You will be graded
– on your ability to succinctly identify key issues addressed by the two authors,
– on your ability to bring out common themes and differences in your final analysis,
– on organization, clarity of writing, and grammar (Have someone read through your work particularly if you are not a native speaker!)

Application: Career Counseling for Clients with Addictive Behaviors
Adjusting assessments and methodologies according to a client’s need is fundamental to the career counseling process. As you prepare for this assignment, consider the various scenarios—an individual’s level of career development and drug addiction stage—that can alter the counseling dynamic.
    To prepare for this assignment:
    · Review this week’s Learning Resources. Focus on the case example of John, on p. 525.
    · Think about how this case example illustrates how an individual may simultaneously be in different stages of change with regard to 1) career development and 2) dealing with drug addiction. Consider the challenges for the counselor and client.
    · Develop a case of your own to use for this assignment. Consider the client you developed for the Week 3 Application Assignment.
    The assignment: (1 – 2 pages)
    · Use the template in the Week 10 Resources section of the class to demonstrate, in client/counselor dialogue form, the transtheoretical model of change (TTM), illustrating how you might counsel a client (NOT “John” from the text) who is in two different stages of change: one stage of change for career development (e.g., Precontemplation) and a different stage of change for dealing with drug addiction (e.g., Action).
    · Apply the four principles of Motivational Interviewing in your scenario, noting how you are demonstrating them in your dialogue.
    · Explain how the scenario you create effectively addresses some of the challenges of working with clients who are in different stages of change for career development and substance abuse.

For years, the term diversity has been associated with specific parameters such as race, ethnicity, gender, sexual orientation, etc. It is important that we continue to understand those dimensions of diversity to evolve our conversation to more global aspects of our cultural selves. The graphic (click to enlarge) illustrates many dimensions of diversity that you may or may not have thought about.
For your initial discussion post think of diversity in all of its dimensions and discuss the concept of “difference.” What does it mean to be “different”? How do you determine who or what is different? Be sure to address the following:

    1. In your family (extended, or otherwise), community, and workplace, what dimensions do you think of when you think someone is “different” than you? Do you focus on different dimensions depending on those three contexts?
    2. Of those dimensions you think of, which can be changed and which cannot be changed?
    3. Of those dimensions you think of, which are visible and which are non-visible? What are the advantages and disadvantages to having non-visible dimensions of diversity rather than visible ones?

    QUESTION

    Nursing

When people are faced with terminal illnesses and death, they usually need support and guidance to identify how they want to live the end of their life. The RN can play a vital role in this process. Ellen Goodman started what is called “The Conversation project” in 2012 to champion this need.

    Initial Discussion Post:

    • Identify and state when end of life conversations should occur and why at that time(s).
    • Identify and describe how as a RN you can promote and support this end of life decision process.
    • Identify and state how the RN’s personal beliefs and feelings can impact having these end of life conversations with patients and families.

Base your initial post on your readings and research of this topic. Your initial post must contain a minimum of 250 words. References, citations, and repeating the question do not count towards the 250 word minimum.

Public Health Disasters & Preparedness     Read through the emergency disasters below. Select one of these scenarios and then complete the following steps:

Scenario No. 1: “Dragon/Volcano Emergency Response”
Scenario No. 2: “Vaccine Gone Awry Emergency Response”
    Scenario No. 3: “Tornado Scenario”
Scenario No. 4: “Tropical Cyclone and Flooding”
    Scenario No. 5: “Zombie Apocalypse”

Imagine you are the director of FEMA using NIMS when this disaster occurs.

Develop a PSA (using either Screencast or video) that informs the  population of what will be done to resolve the issue. Address these  elements in your video:

Describe the nature of the situation.
Explain what FEMA and others are doing to mitigate the situation.
Explain what people need to do to stay safe and/or to get help in order to reduce panic.

Your vocal tone should be one that is meant to reduce panic and provide a solid explanation of the above elements.
Copy and paste the URL to your video or screencast within your  discussion forum response. If you are unable to create a YouTube video  for this discussion, you may use a screencast program. However, you do  not need to develop a PowerPoint presentation. This discussion is meant  to assess your communication abilities, therefore, the audio portion of  the video and/or screencast is essential. If you elect to use the  screencast option, you may simply use a picture of yourself reporting  the above information in lieu of a PowerPoint.

Questions to think about while formulating your response to the public:

What are the issues you will address first?
Which organization is responsible for what? Where will you allocate your resources?
What public health concerns are the results of each of these events?
Which populations might be most at risk?
What are some of the long-term health effects of these events?
What other health concerns may arise from these events?
What will you say to the people, who are desperately awaiting your direction?

Scenario Response Due by Day 7: Imagine that you are  the recipient of the public announcement made by your classmates. In  responding to at least two classmates who used a different scenario than  you, explain how you would respond and react to your classmates’ public  announcement. Do you believe your needs were covered in what the FEMA  director stated? What would you do or say differently?
